Under the law, cases must meet these qualifications in order to qualify:

  1. A doctor/patient relationship existed- as in you and the medical professional had a relationship in which you agreed to their service and they agreed to serve you.
  2. This doctor-patient relationship caused an injury that violates the standard of care.
  3. The injury was caused by the negligence of the medical professional.
  4. The injury led to damages such as a disability, loss of job, suffering, or death.

The key to malpractice claims is proving that a medical professional did not meet the standard of care and was therefore negligent.
