Understanding Your Rights in Worcester for Motorcycle Injuries

So, you’ve been involved in a motorcycle accident in Worcester, Massachusetts, and you’re wondering what your rights are. That’s a really good question. The reality is your rights as driving a motorcycle are no different than a car. Now, I wish that the other driver was really paying attention and watching out for the rider. The reality that we know is they are rarely looking to be careful to make sure there aren’t motorcycles in the other lane coming along. They think they can turn in front of you too fast.

So, what do we have to prove? We have to prove obviously that they were negligent. Negligent means duty, breach, causation, and damages. Duty is simple, right? It means they have the duty to follow the rules of the road to be a reasonable, prudent driver. Breach means they’ve breached that standard of care. They weren’t acting reasonably. They broke the law. They didn’t watch out for you and they cut you off and caused an accident. Damages means that you’re injured. And then causation is the link between the breach and your damages. It means that we show as a result of their breach and that accident is what caused your injuries.

So, we prove those four things and you absolutely win your case. So, those are really your rights. What should you do first? Number one, immediately dial 911. Of course, never leave the scene. Number two, when a rescue comes, get in the rescue. Go to the hospital and get checked out medically. And number three, call our office. Why? Because we care, right? Because number one, I’m a rider. I was my last motorcycle was a 2018 Harley Fat Boy. I’ve been riding street bikes and dirt bikes since I was a kid. So, I understand your perspective. My team understands your perspective. And we’re going to fight as hard as we can to help you win your case.
