What Is the Massachusetts Statute of Limitations for Personal Injury?

The statute of limitations for personal injury claim in Massachusetts is three years from the date of the injury. There are a few exceptions. Like, for example, if the injury wasn’t discovered, which happens with medical malpractice, sometimes people have, say, an instrument or a sponge left inside of them after a surgery and they don’t find out for a long time, months or even a year. Then the statute of limitations begins when they discover that they’ve been injured. Other exceptions include for minors, the statute of limitation doesn’t begin running until they reach the age of majority. In other words, their 18th birthday. So then they have three years to file from the date of their 18th birthday. And lastly, if the claim involves an uninsured motorist or an underinsured motorist, the statute of limitations is actually governed by the contract laws of Massachusetts, which means they have six years to file that particular claim.
