What is the Statute of Limitations for Workers’ Compensation in Massachusetts?

So the question is, how long is the statute of limitations when you’re injured at work in Massachusetts? Well, if you were injured prior to 1986, going way back, the statute of limitations would have been one year, but after 1986, any injury that you’ve suffered currently, the statute of limitations is four years and four years from the date your injury occurred or when you learn that the injury that occurred was tied to your job. It’s work related, work connected. So the clock starts to tick and it’s four years. You have four years to file a claim. Once you file your claim, you’re preserved. If the workers’ compensation carrier accepts your claim and you haven’t filed a claim, meaning they’re paying your medical bills and they’re paying you compensation, that will also stop the clock. So either the workers’ compensation insurance carrier accepts and starts paying you, or you file a claim in court, which stops the clock from ticking. That ticking clock is what preserves your right. If you go beyond that four-year period, what we call the statute of limitations, you are forever barred from bringing a good claim.
