Workers’ Compensation vs. Personal Injury Claims: Which is Right for You?

So workers’ compensation versus personal injury. Do you have to choose? The answer is absolutely not. You can choose both. And that depends on, obviously, how you’re injured and where you were injured. So if you were injured as a result of your job and a third party who is not your employer is the cause of your injuries, then you can pursue both workers’ compensation benefits and a negligence claim or personal injury claim against the third party. Let me give you an example of that. You’re a delivery driver, and so while you’re working, you’re delivering to a business, and while you’re driving that vehicle, someone rear-ends your car. Well, obviously your employer is not responsible for the negligence that occurred to you, but they are responsible for your workers’ compensation claim because you are working at the time of your injury. So you’re entitled to workers’ compensation benefits. However, in addition to workers’ compensation benefits, you’re entitled to the things under a personal injury claim that you would receive from the person who caused the negligence, the third party.
