How Long Do I Have To File a Personal Injury Claim in CT?
The statute of limitations sets the deadline for filing a personal injury lawsuit. In Connecticut, you have two years from the date of the injury to file suit.
There is an exception called the “discovery rule.” If you did not discover your injury until later, the period might not start to run until the discovery date. However, this exception cannot extend your deadline to more than three years after the incident date.
The two-year statute of limitations also applies in wrongful death cases and begins to run on the date of death. However, you must file within five years of the incident for which you claim damages, even if that date is within two years of death.
