What Are the Workers’ Compensation Requirements in South Kingstown?

With very limited exceptions, every employer in Rhode Island must carry workers’ compensation insurance covering their employees.

To qualify for workers’ compensation benefits in South Kingstown, you must be an employee injured within the course of your employment. It doesn’t matter who or what caused the injury—workers’ comp is a no-fault system, so you need not prove that someone else’s negligence was involved.

Your injury may have arisen from a single incident or gradually developed over time. For example, a fall at work or a repetitive-use injury could both make you eligible for workers’ compensation benefits.

According to Rhode Island law, you must report the incident to your employer within 30 days to preserve your right to benefits. You also have two years from the date of the injury to file a workers’ compensation petition. If the injury wasn’t immediately obvious, you must file a petition within two years of the date you knew—or should have known—that it was connected to your job.

What Injuries Qualify for Workers’ Compensation?

Workers’ comp covers a wide range of injuries and illnesses, as long as they arise within the course and scope of your employment. Examples of potentially covered injuries include:

  • Slip and fall accidents: A cashier at South Kingstown Walmart slips on a wet floor and breaks their arm trying to catch themselves.
  • Repetitive stress injuries: A housekeeper at a local hotel develops shoulder pain after years of repetitive cleaning tasks.
  • Lifting injuries: A delivery driver strains their back while unloading heavy packages.
  • Machinery accidents: A manufacturing worker cuts their hand while operating equipment at a South Kingstown plant.
  • Workplace illnesses: A custodian at Peace Dale Elementary School develops respiratory problems after long-term exposure to cleaning chemicals.
  • Burn injuries: A line cook at a Wakefield restaurant suffers burn injuries while working over a hot grill.
  • Traumatic brain injuries: A warehouse worker suffers a concussion after being struck by falling inventory.

What Is the Workers’ Compensation Process?

To begin the workers’ compensation process, you must report the injury to your employer within 30 days. Next, your employer will notify their workers’ compensation insurance company. If your injury causes you to miss more than three days of work, tThe insurer will then file a First Report of Injury with the Rhode Island Department of Labor and Training.

The insurer will review the details and decide whether to accept or dispute your claim. If it accepts your claim, you’ll begin receiving benefits promptly. If it denies your claim, you can file a petition with the Rhode Island Workers’ Compensation Court.

After you file the petition, you may attend hearings with a judge, who will decide how to resolve your claim.

What Types of Benefits Are Available?

Workers’ compensation provides several types of benefits designed to cover both your medical needs and financial losses, including:

  • Medical benefits: Pay for doctor’s visits, hospitalizations, surgeries, medications, rehabilitation, and other treatment required to manage your work injury
  • Wage replacement: Provides weekly payments, generally around 62% of your average wages, to make up for lost income while you cannot work
  • Vocational rehabilitation: Offers job training or placement services if you cannot return to your previous position
  • Permanent disability benefits: Provide additional compensation for permanent disfigurement or the loss of function of a body part
  • Death benefits: Cover funeral expenses and provide financial support to dependents if a worker dies due to a workplace injury

Workers' Compensation FAQs

Explore our answers to common questions about workers’ comp claims in South Kingstown.

Can I Get Compensation for Future Medical Treatments if My Injuries Require Additional Surgeries or Long-Term Rehabilitation?

Yes, workers’ compensation covers most medically necessary treatments. If your doctor confirms that you’ll need additional surgeries, ongoing physical therapy, or other long-term treatment, workers’ comp may cover those costs. However, Rhode Island does have limits on palliative care once you’ve reached maximum medical improvement.

No. Rhode Island is an at-will employment state, which means your employer can generally end your employment at any time and for almost any lawful reason. However, the law prohibits employers from retaliating against workers who assert their right to file workers’ comp claims. If your employer demotes, fires, or threatens you after you report your injury, you may have additional legal options beyond workers’ compensation.

If the insurer denies your claim or you believe you’re entitled to more benefits than the insurer offers, you can file a petition with the Rhode Island Workers’ Compensation Court and present evidence and testimony to a judge.

Contact our attorneys for help. We can review your case and explain your options, which may include filing a formal petition.
