The VA Disability Claims Process

You can file your VA disability claim online, by mail, by fax, or in person at the Department of Veterans Affairs’ regional office in Boston. You can also have an attorney file your claim for you. Our well-versed veterans disability team focuses primarily on VA disability claims.

The VA will need evidence to verify your eligibility. You are not required to submit evidence with your claim, but doing so can prevent delays. If the VA cannot obtain all the necessary evidence, it may request documentation or require you to attend a medical exam.

A claim that includes all supporting evidence is known as a fully developed claim. The evidence may include the following:

  • Medical records – test results, doctor reports, and X-rays from VA and non-VA medical providers
  • Medical contacts – information on how the VA can obtain medical records not in your possession
  • Service records – records related to your service-connected condition
  • Supporting statements – letters from family, friends, clergy, law enforcement, and others familiar with your condition

Our VA disability team can gather these records for you and file a claim. As of March 2025, the average processing time was 135 days.

Common Veterans’ Disability Conditions and Claims

According to the VA, the following are the ten most common conditions for which veterans receive disability:

  • Tinnitus
  • Knee flex limitations
  • Lumbrosacral or cervical strain
  • Loss of motion in an arm
  • Scars and burns
  • Hearing loss
  • Loss of ankle motion
  • Sciatic nerve paralysis
  • Migraine
  • Post-traumatic stress disorder

Some service-connected conditions develop months or years after military service ends, such as cancer and end-stage renal disease. When you apply for benefits, it is not enough to prove you have a disabling condition. You must also prove your military service played a role in the development of your condition. Submitting a complete medical record with detailed doctor’s reports and comments is crucial to proving service connection.

Presumptive Conditions

A presumptive condition is a disability the VA assumes is service-connected. You must still prove the diagnosis, but not its service connection. Whether a condition qualifies as presumptive generally depends on the details of your service, such as your geographical location or occupation while serving.

Below are examples of presumptive conditions:

Veteran’s Disability FAQs

Do I Need an Attorney to File for Veterans Disability?

While you can file for VA benefits without an attorney, it is not advisable. A VA claim lawyer in Lawrence, MA, can help you gather strong supporting evidence and ensure your application is completed correctly.

You may be eligible for VA disability benefits if you served on active duty, inactive duty, or inactive duty training, were not dishonorably discharged, and have a service-connected disability.

If the VA rates your disability too low, our VA disability attorneys in Lawrence can submit a supplemental claim or file an appeal. If the VA previously assigned a disability rating and your condition has progressed, you can request an updated rating by filing VA Form 21-526EZ and submitting supporting evidence. You should only request an update if you are certain your condition has worsened, because the VA could lower your rating.

A service-connected disability is an injury or illness that developed while you were serving in the military, worsened due to your service, or appeared later but has a provable connection to your service. The PACT Act, effective March 5, 2024, expanded eligibility to veterans exposed to burn pits, Agent Orange, and other toxic substances.

If your service record is inaccurate, you must submit DD Form 149 to the branch where you served. If you served in the Army before 1960 or the Air Force before 1964, your records may have been destroyed in a fire at the National Personnel Records Center in 1973. In this case, the VA can help you reconstruct your records. Our VA disability lawyers in Lawrence can help you correct inaccuracies in your military record.
