For more than a quarter century, our personal injury attorneys have helped over 50,000 injured and disabled individuals, recovering more than $2 billion in compensation and benefits. During that time, we have established a proven track record of success in pedestrian accident cases.

We understand the nuances of traffic rules that apply to pedestrian accidents. In addition, we have the resources and experience to challenge insurance companies and fight for the compensation you need to heal.

Our noteworthy pedestrian accident case results include multiple six-figure settlements and verdicts, including the following:

  • $500,000 in a pedestrian death case: Our clients’ loved one was crossing Pawtucket Avenue in East Providence when a car struck and killed him. Attorney Derrin Almada represented his family and collected the full policy limit.
  • $250,000 for a student with severe injuries: The client was skateboarding on America’s Cup Avenue in Newport when a vehicle hit him hard enough for his head to dent the hood. The client suffered multiple abrasions and a concussion that required hospitalization. Attorney Scott Tierney secured damages that supported the client’s recovery, allowing him to catch up at school and graduate on time.
  • $125,000 for a parking lot collision: A car hit our client and pushed them into a parked car, breaking the windshield and fracturing our client’s wrist. Attorney Yile Xu recovered compensation for the client’s damages.

Pedestrian accidents can cause severe injuries with lifelong consequences. Our RI, MA, CT, and NH pedestrian accident lawyers are here to help you get compensation.

Common Causes of Pedestrian Accidents

Pedestrian accidents typically result from the negligence of drivers or others. Contributing causes include the following:

  • Distracted driving: Drivers can easily veer off course or fail to see a pedestrian when eating, using a smartphone, or doing something else that distracts their attention from driving.
  • Speeding: Higher speeds reduce the time a driver has to avoid a pedestrian and increase the risk of losing control.
  • Failing to stop at stop signs and crosswalks: Drivers are legally required to yield to pedestrians in crosswalks and at stop signs. Failure to do so results in countless pedestrian accidents.
  • Running red lights: A pedestrian has the right of way to cross the road if oncoming cars have a red light.
  • Failure to yield: Pedestrians expect drivers to follow yield signs. Not doing so can put a car and a pedestrian on track for a collision.
  • Impaired driving: Driving under the influence of alcohol is illegal in every state. Alcohol impairs reasoning, decision-making, and muscle coordination, making crashes much more likely.
  • Poor road conditions: Potholes and other hazards can make a driver lose control of their car.
  • Inadequate pedestrian infrastructure: Insufficient crosswalks and pedestrian signals encourage people to jaywalk, putting them in harm’s way.
  • Driver fatigue: Drowsiness reduces a driver’s awareness, attention, and reaction times, making them potentially as dangerous as an intoxicated person.
  • Aggressive driving: Aggressive drivers may disregard pedestrian safety measures, causing collisions.
  • Weather conditions: Poor weather can make roads slick and interfere with visibility.

Types of Injuries in Pedestrian Accidents

Because they have no protection from an impact, pedestrians are particularly vulnerable to serious injuries, such as the following:

  • Broken bones: Simple or compound fractures
  • Traumatic brain injuries, or TBIs: Damage to the brain due to impact by an outside force
  • Spinal cord injuries: Damage to the nerve fibers that coordinate movement, sensation, and reflexes
  • Internal injuries: Wounds inside the body, typically to the organs or blood vessels that supply them
  • Road rash and skin abrasions: Painful friction wounds from the body scraping along the ground, potentially causing infection or scarring
  • Fractured or dislocated joints: Cracking or separation of the bones that make up a knee, elbow, or other joint
  • Soft tissue injuries: Damage to the muscles, ligaments, and tendons that facilitate movement
  • Neck and back injuries: Wounds that can cause mobility issues, degenerative bone conditions, and chronic pain
  • Psychological injuries: Accident-induced mental health challenges, such as anxiety, depression, or post-traumatic stress disorder

Steps To Take Immediately After a Pedestrian Accident

What you do after an accident matters. Take the following steps immediately after a pedestrian accident to ensure your health and preserve your right to compensation:

  • Seek medical attention immediately: Timely treatment may reduce your risk of long-term damage, and health care records are essential evidence in injury claims. Even if you don’t think you’ve been injured, have a medical professional evaluate you. Many injuries are not immediately apparent after an accident.
  • Report the accident to the authorities: Call the police and describe the accident to the arriving officer. Request a copy of the report for your claim. The police report can provide valuable evidence to support your claim.
  • Document the scene if possible: Evidence can disappear as conditions change and memories fade. Take photos from multiple angles and get contact information from witnesses.
  • Contact a pedestrian accident attorney: An attorney can explain your rights and help you hold responsible parties accountable.

How Long Do I Have to File a Pedestrian Accident Claim?

In Rhode Island, Massachusetts, and New Hampshire, the statute of limitations for personal injury claims is three years. There are some exceptions. For instance, New Hampshire’s law recognizes the “discovery rule,” meaning that if your injury could not reasonably have been discovered until later, the three-year period starts on the date of discovery.

Connecticut’s statute of limitations gives you two years from the accident date to file suit. If the victim discovered the injury later, the deadline is two years from discovery but no more than three years from the accident date.

You will likely lose your right to sue if you miss the deadline. Consult an attorney as soon as possible to ensure you file your claim on time.

What Compensation Is Available for Pedestrian Accident Victims?

Victims of pedestrian accidents have the right to seek compensation for their losses. In a personal lawsuit, you can seek recovery of the following compensatory damages:

  • Economic damages cover financial losses like medical bills, lost wages, property damage, and expenses for accident-related disabilities. You can also claim future costs of related injuries and lost earning capacity.
  • Non-economic damages compensate for pain and suffering, mental anguish, loss of enjoyment of life, and other intangible losses. The value of these losses usually depends on the economic damages you claim.

The total value of your claim depends on the circumstances of your case, including the nature and severity of your injuries and the costs associated with the accident.

Is a driver at fault if a pedestrian is hit while jaywalking?
Pedestrians jaywalking at the time of an accident typically share at least partial fault with the driver, but the circumstances differ by case. The consequences jaywalking may have on your case depend on comparative negligence laws, which vary by state.
If you have an automobile insurance policy with uninsured motorist coverage, you might be entitled to file a claim under your policy. You may also be able to sue the driver directly.

Under our Free Fee Guarantee®, our attorneys work on a contingency fee basis. Therefore, you don’t pay us unless you win, in which case you pay an agreed-upon percentage of your settlement or award.
