Can You Still Recover Damages if the Accident Was Partially Your Fault?

You can absolutely recover and be compensated even if the accident was your fault. In Rhode Island, we have what’s called pure comparative negligence, which means that even if you are 99% at fault, you can still recover for 1% of your injuries. Massachusetts, they have what’s called modified comparative negligence, which means that if you are less than 51% at fault, you can still recover. So you cannot be more at fault than the defendant.
