Who Can Be Held Liable After a Dog Bite Attack?

The question always comes up is who’s responsible, right? Which defendant do we go after in a dog bite case? And it really depends on the law, in the state, in the city, and where the dog bite happened. So, if it’s in public, generally speaking, it’s only going to be the owner of the dog. If it’s in a property, you have the potential of the owner of the dog as well as the owner of the property if the owner either knew or should have known that the dog was there. And there’s no insurance barring it. So there are sometimes in the insurance policy it says it won’t cover dog bites. So that can always be an issue for us. Doesn’t mean you can’t sue the owner directly, but it means there won’t be insurance. So it really depends on where it occurred, what state it occurred in, what the law is.
