The question comes up when you’re in a motor vehicle accident and the city is involved. So let’s say you’re in Rhode Island and one of the cities are involved. Can you sue that city if they’re responsible? So of course, first we always look at negligence. And so if you’re involved in a motor vehicle accident with an ambulance, a fire truck, a police car, then absolutely they owe you the same duty of care to any other vehicle. If there’s a problem with the roadway that caused an accident, let’s say a construction zone and things like that, then we look at the facts and see whether or not that city owed you a duty based on the fact that they didn’t put up a flagger, they mis flagged in a zone, they put out cones improperly, they left an area where there’s a hole that caused the motor vehicle accident. So, the answer is if we can find the city negligent, you absolutely can sue the city.
