So I got asked the other day, I got rear-ended. Who’s at fault? I kind of chuckle, right? You would think common sense. Clearly, the person behind you that rear-ends you is at fault for the accident. However, I have to tell you, I had a case once where the person was rear-ended and the defendant literally said, no, no, they backed up into me. Yeah, they were on a road with a speed limit of 30 miles an hour and they’re saying my client literally backed up into them so we were able to prove that wasn’t true but the answer is generally speaking if you get rear-ended it’s the other person’s fault it doesn’t matter if you have to stop short a kid came out in the road an animal came out on the road the reality of the law is that the defendant the person behind you has to maintain a safe driving distance. So they have to make sure that under any circumstances, when you step on the brakes, because no one ever knows what’s ahead, is a kid gonna run out, a deer gonna run out, what’s gonna happen? When you hit the brakes, they have to be behind you far enough so they have time to stop. And if they didn’t maintain a safe following distance and rear end you, they’re at fault.
