- A doctor/patient relationship existed- as in you and the medical professional had a relationship in which you agreed to their service and they agreed to serve you.
- This doctor-patient relationship caused an injury that violates the standard of care.
- The injury was caused by the negligence of the medical professional.
- The injury led to damages such as a disability, loss of job, suffering, or death.
The key to malpractice claims is proving that a medical professional did not meet the standard of care and was therefore negligent.
