How Can an Experienced Tampa Personal Injury Lawyer Help?

A personal injury lawyer handles all the legal details when you are pursuing a claim for an accident caused by someone else’s negligence. An experienced personal injury lawyer will manage many crucial aspects of your case, including investigating, collecting evidence, retrieving your medical records, communicating with insurance companies, and negotiating a fair settlement. If a settlement cannot be reached, your personal injury lawyer will file a lawsuit, litigate your case, and advocate for you at trial.

Hiring an experienced personal injury lawyer can significantly improve the outcome of your case and make all the difference in whether you recover the full compensation you deserve.

The legal system recognizes that it is inherently unfair for you to suffer, due to another person’s mistake without compensation. Financial awards may never fully compensate you for personal losses, including lifelong injuries or the loss of a loved one. However, an experienced personal injury lawyer will advocate for a settlement that accounts for all your losses, even the most painful.

Quantifying the value of your personal injury claim can be challenging for a non-legal professional. It is best to speak with one of our experienced personal injury lawyers to determine your potential compensation. Courts typically base compensation on both economic damages, such as medical bills and lost wages, and non-economic damages, including loss of employability, loss of quality of life, and pain and suffering. It is essential to save receipts and document all expenses related to the injuries and suffering of every injured party.

FAQs About Your Injury or Accident Case

What damages can I be compensated for?

Personal injury damages include lost wages, medical bills, pain and suffering, property damage, out of pocket expenses, scarring, compensation for any permanent injury, and compensation for any future medical costs. Florida does allow punitive damages to be awarded, but this only occurs in rare cases of extreme, intentional misconduct or gross negligence.

Many personal injury cases are complex, so consider hiring a personal injury firm like Rob Levine Law. We will do our best to investigate, obtain the facts, and help you understand your options. At Rob Levine Law, we do not charge for consultations.

A personal injury case is when someone else does not act carefully, and you are injured because of that. To show that the other person was careless, you must prove four things:

Duty: They were supposed to be careful. Everyone is supposed to act safely and reasonably. Drivers must pay attention and obey traffic signals and signs. Property owners must make sure their property is free from hazards that could hurt people.

Breach: They didn’t do the careful thing they should have done. A driver looked at their phone while driving. A home or business owner had a deep hole on their property and did not fill it or tell people to watch out for it.

Causation: The careless thing they did caused you to be hurt. You have to prove what they did caused you to be injured. The driver looking at their cell phone is why they ran the red light and hit your car. The property owner not filling the hole or telling you it was there is why you stepped in it and broke your ankle.

Damages: You suffered injuries and needed to see a healthcare professional. This is where you must prove economic (such as medical bills and lost wages) and non-economic (such as pain and suffering, loss of enjoyment of life, or emotional distress) damages.

Your health should be your priority. See a healthcare professional and follow their orders. During the case, do not discuss the accident with the at-fault party’s insurance company, as this could unintentionally help build their case against you. Hiring an experienced personal injury lawyer will help you navigate the process.

Dial 911 and report the accident. Let them know if there are any injuries and always request a rescue if you are injured.

Never move your vehicle prior to the police arriving unless it is blocking traffic. You must make a reasonable effort to move the car to a safe location so as not to block traffic.

If you can exit your vehicle, take pictures of the accident scene from a distance so you can see all of the vehicles involved in one picture. Then take close-up pictures of each vehicle involved. Make sure to capture the damage, license plate of the vehicle, and a picture of the driver.

If there is a witness to the accident, ask them to wait for the police to arrive so they can give a statement. If they cannot wait, ask if you can take a picture of their identification and then include a picture of them holding their information that you can read.

Once the police arrive, make a statement as to how the accident occurred. Ensure that the police talk to the witness and take their statement as well. If the witness left prior to the police arrival, show the police officer a picture of the witness and their identification. Make sure the police report notes them as a witness who had to leave before the police arrived.

If you are injured, never refuse medical treatment by rescue personnel. Be transported by ambulance to the nearest hospital to get medical treatment.

If the police are unable to respond and you or the other driver needs to leave, you have two options:

  1. You and the other driver can agree to follow each other and meet at the police department to make a report.
  2. Florida law requires that if law enforcement does not complete a report, the drivers involved must file a written crash report within 10 days.

You must see a healthcare professional right after your accident, whether you feel pain or not. Your body’s natural adrenaline will likely kick in, meaning your body is in initial shock. Once that wears off, you will be able to feel the effects of your injuries. With or without pain, you may have severe internal injuries that need immediate diagnosis and treatment. Even if your injuries are minor, the sooner you see a medical provider, the more comprehensive your medical records will be. This will help build a stronger case.

If you lose the case, you won’t be responsible for our attorney’s fees. We work on a contingency fee basis, meaning you only pay if you win your case. However, you may still be responsible for other costs, such as court fees or expert witness expenses, depending on the agreement. We will make sure you understand what, if anything, you’ll have to pay before we take your case so you can focus on your recovery instead of worrying about money.

We may be able to help cover your medical care costs through your insurance or by negotiating with healthcare providers. Additionally, any settlement or verdict in your case may include compensation for ongoing treatment.

At Rob Levine Law, we have Spanish-speaking, as well as other multilingual, attorneys and staff who can assist you throughout the legal process. Contact us, and we’ll ensure you have the support you need in your preferred language.

If the insurance company is being uncooperative or trying to minimize your claim, it’s important to consult with an experienced personal injury attorney. We can handle communication with the insurer, advocate for your rights, and ensure you get fair compensation.

If you want to resolve your case quickly, we can explore settlement options. However, it’s important to understand that rushing the process could affect the compensation you receive. We will guide you through the fastest resolution that ensures your best interests are protected.
