Hi, I’m attorney Rob Levine. So, you’re having a really bad day. Someone stole your car and they got into an accident and injured someone. The question I get is, “Am I responsible? Does my insurance company have to pay?” The answer is absolutely not. There’s something we call permissive use. If the person using your car did not have permission, didn’t have reasonable access, you didn’t provide them your keys and let them use your vehicle, they stole it or took it without permission, then your insurance company’s not on the hook and you’re not responsible. But make sure that you report the car stolen because if you don’t, the police department is going to certainly question whether or not that person really had permission or not and could leave you liable. Thanks for stopping by.
